These Terms of Service (“Terms”) govern your access to and use of hermesdigital.co (the “Site”) and any services provided by Hermes Digital (“we,” “us,” or “our”), including vector art conversion, embroidery digitizing, custom patch design, logo and branding, graphic design, UI/UX design, web development, and IT security services (collectively, the “Services”). By accessing our Site or placing an order, you agree to be bound by these Terms.
Services Provided
Hermes Digital provides design, digitizing, development, and IT security services as described on our Site. Specific deliverables, pricing, and turnaround times will be confirmed for each order via quote, invoice, or written agreement.
Quotes and Orders
- All projects begin with a quote based on the files, requirements, and complexity you provide
- Quotes are valid for 14 days unless otherwise stated
- Orders are confirmed once payment (or agreed deposit) is received
- We reserve the right to decline any order at our discretion
Pricing and Payment
- Prices listed on our Site are starting prices and may vary based on complexity, size, and turnaround requirements
- Payment is due as specified at the time of order (full payment or deposit, depending on project size)
- We accept payment through the methods listed at checkout or in your invoice
- Late or failed payments may result in delays or suspension of work
Turnaround Time
Standard turnaround times vary by service and are communicated at the time of quote. Rush delivery may be available for an additional fee. Turnaround begins once all required files and information are received from the client.
Revisions
- Minor edits and file format conversions are included free of charge for most services, as specified on individual service pages
- “Minor edits” refers to small adjustments such as color changes, resizing, or text corrections — not a complete redesign
- Major changes to design direction after work has begun may incur additional charges
Client Responsibilities
You are responsible for:
- Providing accurate project requirements and source files
- Ensuring you have the legal right to use any artwork, logos, or content submitted to us
- Reviewing and approving proofs/previews in a timely manner
- Providing timely feedback to avoid project delays
Intellectual Property
- Upon full payment, you receive ownership rights to the final deliverable created specifically for your project
- Hermes Digital retains the right to use completed work in our portfolio, marketing materials, and case studies unless you request otherwise in writing
- You warrant that any artwork, logos, or content you provide does not infringe on third-party intellectual property rights
- Any pre-existing tools, templates, or proprietary processes used to create your deliverable remain the property of Hermes Digital
Cancellations
- Orders may be canceled before work begins for a full refund, less any processing fees
- Once design or digitizing work has started, cancellation refunds are calculated based on work completed (see our Refund Policy for full details)
Limitation of Liability
To the maximum extent permitted by law, Hermes Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim shall not exceed the amount paid for the specific service in question.
Website Development and Hosting Disclaimer
For web development and IT security services, Hermes Digital is not responsible for third-party hosting outages, domain registrar issues, or damages resulting from client-side modifications made after project delivery, unless covered under an active maintenance agreement.
Confidentiality
We treat all client project files, business information, and communications as confidential and will not share them with third parties except as necessary to complete your project or as required by law.
Termination
We reserve the right to suspend or terminate access to our Services for any client who violates these Terms, engages in abusive conduct, or fails to make required payments.
Governing Law
These Terms are governed by applicable laws without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the appropriate courts.
Changes to These Terms
We may update these Terms at any time. Continued use of our Site or Services after changes are posted constitutes acceptance of the revised Terms.
